Current State: Settlement

 

A judge in the Superior Court of the State of California for the County of Los Angeles has preliminarily approved a class action settlement in the matter of Victor Mejia and Irma Ruiz, et al. v Baker Commodities, Inc (Case No.: 22STCV35845)

The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $400,000, less costs, and attorneys’ fees, for members of the Certified Class, which is defined as follows:

All owners/occupants and renters of residential property within three-quarters (0.75) of a mile from the Baker Commodities Facility located at 4020 Bandini Boulevard in Vernon, California (“Baker Facility”) between November 14, 2019, and the present, and all residents who submitted a Data Sheet to Class Counsel prior to March 1, 2024, indicating that they experienced odors that they alleged to be attributed to the Baker Facility.

 

The lawsuit, filed in 2022, alleged airborne emission of pollutants, air contaminants, and noxious odors from the facility created a nuisance for neighboring residents.

There are several Court-ordered deadlines that must be followed by members of the class:

 

· Claim Forms must be postmarked on or before May 5, 2025, in order to receive compensation from the Settlement Fund.

 

· Opt Outs and Objections must be postmarked on or before April 18, 2025.
