A judge in the United States District Court for the Eastern District of Michigan, has preliminarily approved a class action settlement in the matter of Crocker v. Cleveland-Cliffs Steel Corporation d/b/a/ AK Steel Dearborn Works, (Case No.: 4:21-cv-11937)
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $975,000 dollars, less costs, and attorneys’ fees, for members of the Certified Class, which is defined as follows:
All (i) owners and occupants and (ii) renters of residential property residing within the SEP Area (See Map below) at any time since July 20, 2018, and any households that returned Data Sheets to Class Counsel on or before September 5, 2024.
The lawsuit, filed in 2021, alleged airborne emission of noxious odors and dust from the facility created a nuisance for neighboring residents.
There are several Court-ordered deadlines that must be followed by members of the class:
Claim Forms must be postmarked on or before June 14th, 2025, in order to receive compensation from the Settlement Fund.
Opt Outs and Objections must be postmarked on or before May 30th, 2025.
