Current State: Settlement
A judge in the Court of Common Pleas of Alleghany County, Pennsylvania, has preliminarily approved a class action settlement in the matter of Frederickv. Harsco Corporation, (Case No. GD 20-011140)
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $1,000,000, less costs, and attorneys’ fees, for members of the Certified Class, which is defined as follows:
All owner/occupants and renters that occupied any residential real property located within one (1.0) mile of the Harsco Environmental Facility located at Federal Street, Gate #10, Natrona, Pennsylvania, at any time since October 28, 2018, to the present.
The lawsuit alleged airborne emission of pollutants, air contaminants, and noxious odors from the facility created a nuisance for neighboring residents. Personal injury claims are not released under the Settlement Agreement.
There are several Court-ordered deadlines that must be followed by members of the class:
Claim Forms must be postmarked on or before May 1, 2026, in order to receive compensation from the Settlement Fund.
Opt Outs and Objections must be postmarked on or before April 18, 2026.
