A judge in the Circuit Court of the State of Illinois, County of Cook, Chancery Division, has preliminarily approved a class action settlement in the matter of Rodriguez vs. MAT Asphalt LLC. (Case No.: 2020-CH-07031)
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $1.2 million dollars, less costs, and attorneys’ fees, for members of the Certified Class, which is defined as follows:
All owner/occupants and renters of residential property with a physical, residential structure or any part thereof located within a half (.5) mile of the facilities’ property boundary located at 2055 W. Pershing Rd, Chicago, Illinois at any time since July 20, 2018.
The Settlement also dictates that certain improvement measures totaling $900,000 dollars will be implemented at the facility by April 30, 2024.
The lawsuit, filed in 2020, alleged that noxious odors from the facility created a nuisance for neighboring residents.
There are several Court-ordered deadlines that must be followed by members of the class:
· Claim Forms must be postmarked on or before March 15, 2024, in order to receive compensation from the Settlement Fun.
· Opt Outs and Objections must be postmarked on or before March 15, 2024.
Attorneys Will host a Community on February 20, 2024 from 4-7 p.m. at the Richard M. Daley Public Library located at 733 N Kedzie Ave, Chicago, IL 60612 to answer questions.
A second community meeting will also be hosted by the lawyers on Tuesday, February 27th, from 5-8 p.m. at the Bethany Baptist Church of Chicago, located at 3532 South Hoyne Avenue, Chicago, IL 60609.
