A judge in the Court of Common Pleas of Allegheny County, Pennsylvania, has preliminarily approved a class action settlement in the matter of Kowal v. Metalico Pittsburgh, Inc., (Case No.: G.D. 21-13665 )
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $535,000 dollars, less costs, and attorneys’ fees, for members of the Certified Class, which is defined as follows:
All owner/occupants and renters of residential property with a physical, residential structure or any part thereof located within approximately one (1.0) mile of the vicinity of the Metalico facility located 3100/3400 Grand Avenue, Pittsburgh, PA 15225, at any time from November 5, 2019, to the present.
The Settlement also dictates that certain improvement measures will be implemented at the facility.
The lawsuit, filed in 2021, alleged airborne emission of pollutants, air contaminants, and noxious odors from the facility created a nuisance for neighboring residents.
There are several Court-ordered deadlines that must be followed by members of the class:
· Claim Forms must be postmarked on or before August 18, 2025, in order to receive compensation from the Settlement Fund
· Opt Outs and Objections must be postmarked on or before August 2, 2025.
