Current State: Settlement
A judge in the Court of Common Pleas of Butler County, Ohio, has preliminarily approved a class action settlement in the matter of Douglas Baker, et al. v. Cleveland-Cliffs Steel Corporation, (Case No. CV 2022 03 0358)
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $1,000,000.00, less costs, and attorneys’ fees, for members of the Certified Class, which is defined as follows:
All owner/occupants and renters of residential property with a physical, residential structure or any part thereof located within one (1) mile of the steel manufacturing plant, located at 1801 Crawford Street, Middletown, Ohio (the “Middletown Works”) at any time since March 11, 2018, to the present.
The lawsuit alleged airborne emission of pollutants, air contaminants, and noxious odors from the facility created a nuisance for neighboring residents. Personal injury claims are not released under the Settlement Agreement.
There are several Court-ordered deadlines that must be followed by members of the class:
· Claim Forms must be postmarked on or before September 15, 2025, in order to receive compensation from the Settlement Fund.
· Opt Outs and Objections must be postmarked on or before September 2, 2025.
