Current State: Settlement
A judge in the United States District Court for the Western District of Pennsylvania, Pittsburgh Division, has preliminarily approved a class action settlement in the matter of Franci et al v. Chambers Development Company, INC., (Case No. 2:24-00800)
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $800,000, less costs, and attorneys’ fees, for members of the Certified Class, which is defined as follows:
All owner/occupants and renters that occupied any residential real property located within one (1) mile of the Chambers Development Company Facility located at 600 Thomas Ave, Monroeville, Pennsylvania at any time from March 28 2021, to the present.
The Settlement also dictates that certain improvement measures totaling $400,000 dollars will be implemented at the facility by December 31, 2027.
The lawsuit alleged airborne emission of pollutants, air contaminants, and noxious odors from the facility created a nuisance for neighboring residents. Personal injury claims are not released under the Settlement Agreement.
There are several Court-ordered deadlines that must be followed by members of the class:
Claim Forms must be postmarked on or before April 20, 2026, in order to receive compensation from the Settlement Fund.
Opt Outs and Objections must be postmarked on or before April 4, 2026.
