Current State: Settlement
A judge in the Massachusetts Superior Court, Bristol County, has preliminarily approved a class action settlement in the matter of Skapik v. P.J. Keating Company (Case No.: 2173CV00914B)
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $1,400,000, less costs, and attorneys’ fees, for members of the Certified Class, which is defined as follows:
All owner/occupants and renters of residential property with a physical, residential structure or any part thereof located within approximately one (1.0) mile of the vicinity of the P.J. Keating Company located at 72 South Main Street, Acushnet, Massachusetts, at any time from December 23, 2018, to the present.
The Settlement also dictates that certain improvement measures totaling $700,000 dollars will be implemented at the facility within one year.
The lawsuit, filed in 2021, alleged airborne emission of pollutants, air contaminants, and noxious odors from the facility created a nuisance for neighboring residents.
There are several Court-ordered deadlines that must be followed by members of the class:
· Claim Forms must be postmarked on or before May 9, 2025, in order to receive compensation from the Settlement Fund.
· Opt Outs and Objections must be postmarked on or before April 24, 2025.
