Current State: Settlement
A judge in the Circuit Court of Cook County, Illinois, has preliminarily approved a class action settlement in the matter of Stillmaker and Merza v. Prestige Feed Products LLC and Cereal Byproducts Co., Inc., (Case No. 2024 CH 01504)
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $900,000, less costs, and attorneys’ fees, for members of the Certified Class, which is defined as follows:
All owner/occupants and renters that occupied any residential real property located within one half (0.5) mile of the Prestige Feed Facility located at 431 N. Lakeview Court, Suite A, Mount Prospect, Illinois, at any time since March 2019, to the present.
The lawsuit alleged airborne emission of pollutants, air contaminants, and noxious odors from the facility created a nuisance for neighboring residents. Personal injury claims are not released under the Settlement Agreement.
There are several Court-ordered deadlines that must be followed by members of the class:
Claim Forms must be postmarked on or before June 20, 2026, in order to receive compensation from the Settlement Fund.
Opt Outs and Objections must be postmarked on or before June 5, 2026.
