Current State: Settlement
A judge in the United States District Court for the Northern District of Illinois, has preliminarily approved a class action settlement in the matter of dela Cruz et al v. Smithfield Packaged Meats Corporation, (Case No. 1:23-cv-17032)
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $550,000, less costs, and attorneys’ fees, for members of the Certified Class, which is defined as follows:
All owner/occupants and renters that occupied any residential real property located within one-and-two-tenths (1.2) miles of the Smithfield Packaged Meats Facility located at 410 South Kirk Road, St. Charles Illinois at any time from December 20, 2018, to the present.
The lawsuit alleged airborne emission of pollutants, air contaminants, and noxious odors from the facility created a nuisance for neighboring residents. Personal injury claims are not released under the Settlement Agreement.
There are several Court-ordered deadlines that must be followed by members of the class:
Claim Forms must be postmarked on or before October 20, 2025, in order to receive compensation from the Settlement Fund.
Opt Outs and Objections must be postmarked on or before October 6, 2025.
