Sprague Settlement Information
The U.S. District Court for the District of Rhode Island has preliminarily approved a class action settlement in the matter of Agudelo v. Sprague Operating Resources, LLC, Case No. 1:20-cv-00407. The lawsuit alleged that noxious odors from the Sprague Facility, located at 144 Allens Ave in Providence, Rhode Island, created a nuisance for neighboring residents. The company denies any responsibility for any alleged nuisance.
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for the creation of a cash fund of $750,000 for the benefit Settlement Class Members who timely fill out a valid claim form. The Settlement requires Defendant to invest in Odor Control Measures, which include maintaining the mist eliminators and carbon absorption vessels, and replacing the activated carbon, as necessary, based on pressure drop measurements across the carbon adsorption systems, at an estimated annual cost of approximately $35,000 to $40,000, to mitigate potential odors associated with the operation of the Sprague Facility.
The Class in this lawsuit consists of all persons who have owned rented, or leased any residential property located in whole or in part within the defined Class Area near the Sprague Facility, at any time since September 14, 2010, and who do not affirmatively Opt-Out of this Settlement. The defined Class Area is depicted on the Class Area Map (Click Here).
There are several Court-ordered deadlines that must be followed by members of the class:
Claim Forms must be postmarked on or before March 13, 2023 in order to receive compensation from the Settlement Fund.
Opt-Outs and Objections must be postmarked on or before February 27, 2023.
The Court will hold a Fairness Hearing on April 25, 2023 at 2:00pm to consider whether to grant final approval of the Settlement. The hearing will be held via Zoom (Zoom Meeting ID: 161 516 6522, Passcode: 512657).
