Current State: Settlement

A judge in the United States District Court for the Western District of Kentucky, Louisville Division, has preliminarily approved a class action settlement in the matter of Vail v. Swift Pork Company, (Case No. 3:22-cv-354-DJH-RSE)

The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $500,000, less costs, and attorneys’ fees, for members of the Certified Class, which is defined as follows:

All owner/occupants and renters that occupied any residential real property located within one (1) mile of the Swift Pork Company Facility located at 1200 Story Avenue, Louisville Kentucky at any time from July 11, 2017, to the present.

The settlement also calls for $430,000 in improvement measures aimed at reducing any alleged emission of off-site odors.

The lawsuit alleged airborne emission of pollutants, air contaminants, and noxious odors from the facility created a nuisance for neighboring residents. Personal injury claims are not released under the Settlement Agreement.

There are several Court-ordered deadlines that must be followed by members of the class: 

  • Claim Forms must be postmarked on or before February 6th, 2026, in order to receive compensation from the Settlement Fund. 

  •  Opt Outs and Objections must be postmarked on or before January 26, 2026.
