Current State: Settlement
A judge in the Commonwealth of Massachusetts Superior Court, has preliminarily approved a class action settlement in the matter of McDonald and Peters v. Twin Rivers Technologies Manufacturing Corporation, (Case No. 2482CV00295)
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $800,000, less costs, and attorneys’ fees, for members of the Certified Class, which is defined as follows:
All owner/occupants and renters that occupied any residential real property located within .75 (3/4) mile of the Twin Rivers Technologies Facility located at 780 Washington Street, Quincy, Massachusetts at any time since March 26, 2021, to the present.
The settlement also calls for $200,000 in improvement measures on the facility
The lawsuit alleged airborne emission of pollutants, air contaminants, and noxious odors from the facility created a nuisance for neighboring residents. Personal injury claims are not released under the Settlement Agreement.
There are several Court-ordered deadlines that must be followed by members of the class:
Claim Forms must be postmarked on or before April 27, 2026, in order to receive compensation from the Settlement Fund.
Opt Outs and Objections must be postmarked on or before April 13, 2026.
