Current State: Settlement
A judge in the Circuit Court for the County of Wayne, Michigan, has preliminarily approved a class action settlement in the matter of Paul Burks, et al. v. EQ Detroit Inc. d/b/a US Ecology Detroit South, (Case No. 24-001478-NZ)
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $780,000, less costs, and attorneys’ fees, for members of the Certified Class, which is defined as follows:
All owner/occupants and renters of residential property with a physical, residential structure or any part thereof located within one (1) mile of the US Ecology Detroit South Facility, located at 1923 Frederick St. in the City of Detroit (“US Ecology Detroit South Facility”), at any point in time since January 31, 2021 to the present.
The Settlement also dictates that the Defendant will expend at least $1,560,000 in Environmental Control Measures over the next three years to mitigate and prevent potential odors associated with the operation of the US Ecology Detroit South Facility.
The lawsuit alleged airborne emission of pollutants, air contaminants, and noxious odors from the facility created a nuisance for neighboring residents.
There are several Court-ordered deadlines that must be followed by members of the class:
· Claim Forms must be postmarked on or before July 3, 2025, in order to receive compensation from the Settlement Fund.
· Opt Outs and Objections must be postmarked on or before June 18, 2025
